Thabk you for your advice. They did say that I will have to go to a police station and submit fingerprints. I tried several online free "background checks", though I know that they aren't exactly FCRA consumer checks, and I did not pop up.

Thanks! I'll move forward. I greatly appreciate your advice.

This is what I feared. Thank you, I will keep my options open.

Thanks for your advice, I will put that into consideration.

1. There being a high probability of losing is very different than the absolute guarantee of it.

2. I do not have the financial resources to hire an attorney.

3. I have been studying these technical rules for literal years.

4. I have accumulated dozens of pages of proof during the course of my incarceration that I was arrested, tried, and convicted without the existence of:

• An arrest warrant
• A criminal complaint
• Affidavit of probable cause
• Indictment
• Waiver of indictment
• Any discernible existence of any grand jury proceedings

4. I am suspicious of attorneys. I had a $70,000 attorney who told me that I had absolutely no rights before the law because of my charge and allowed the prosecution to proceed without any of the strictures of law. I was literally kidnapped and convicted without any proceedings, I attended court thrice.

Bender's law forms pretty much does that for you for every rule of Civil or Criminal procedure. In addition to having skeletal forms, it explains each rule in depth with case precedents stretching as far as the most recent edition's publications. No attorney "memorizes" these. They become familiar with particular aspects of the law and the evidence which corroborates their perspectives over time. It is intellectually dishonest to suggest that they are memorizing content as opposed to becoming expert researchers of the sources of law.

Let alone that case precedent is not the sort of binding law provided for in the Constitution as "Supreme". They are unofficial dicta which jusr serve as game rules differing between the Districts. Some Districts flagrantly flout Supreme Court "precedents" without repercussion.

2) Can you recommend any such services?

3) I think my circumstances are somewhat idiosyncratic but I have experience filing in the courts which is reasonahle for my circumstances.

4) I filed a certified statement of material facts and attached them as an exhibit. Is there a further vetting process?
5) This is my first time in this subreddit.

Currently incarcerated in a residential reentry center.

Can you recite, word for word, anything from Civil procedure from the tip of your head? I come from an intellectual tradition wherein memorize means the ability to recite verbatim. Maybe that's where our confusion stems from.

I was actually relatively successful in other affairs, this is my first attack on my criminal case. You're making a lot of assumptions and I'm not sure why. I responded to point 5 in another comment. Still getting used to Reddit.

This is not constructive criticism or advice. You can point me towards some legal aid or you can directly assist me. Repeating, "you will fail" does not help anyone, including you. I personally have witnessed far less capable inmates succeed on such filings with a far less fluency in the law than I. This notion that you need 4 years of law school to accomplish anything is not only elitist, it's just not true. I am willing to learn, but not to be attacked without purpose.

Thanks for your opinion. I appreciate it. You are making too many assumptions and offering quite a few suggestions. I just wanted to know if there was a set time period for a judge to make a particular decision on a particular motion. You seem to be getting somewhat heated, which I do not understand.

You began descending into ad hominems by looking at my post history and commenting on my attempts to secure employment despite the fact that I have a very public juvenile criminal record, for a "crime" in which no one was physically hurt nor was significant financial damage caused. Regardless, I do appreciate it. I certainly care about the outcome of my case. I am just unconvinced by some of your arguments. We can agree to disagree. At this point, my petition has already been filed, so whatever help a trained attorney could have at this point anyway will be limited. However, if an order to show cause is filed, I will certainly try to seek such aid. I may begin researching now.

Skimmed through it, it seems to be the same stuff I included in my "Jurisdiction" and "Venue" sections of my 2241. I am currently in the custody of the US AG, incarcerated. 2241 is the appropriate venue.
