The overarching theme of Jimmy's story is defiance. Jimmy is incapable of submission, even when submission is the right thing to do or when it's beneficial to him. Jimmy has a need to defy and resist, to demonstrate that no one person or system is dominant over him.

When Jimmy sees his father get scammed, he has the choice to submit to the cruelty of the world and be a good person or to defy it and corrupt himself. He chooses defiance.

Even when the system lets Jimmy in, when Jimmy is given a glitzy high paying job and every conceivable accomodation - he is absolutely compelled to defy his superiors and colleagues in a downright self destructive fashion.

Then later on he goads the girl with a record who doesn't receive the Chuck scholarship by claiming "they" will never let people like "us" in. Because Jimmy believes that once you are labeled to be disadvantaged, you are some kind of a victim. But Jimmy was a major voting member on that same committee, his opinion was given weight, and he had multiple golden opportunities squandered away.

Jimmy definitely had some kind of oppositional defiance disorder that made him compulsively throw up the finger to anyone or thing he perceived as dominating him. Even when he is in Nebraska, he has to defy the safety protocols he himself has set in place and start pushing the limits until he ultimately gets caught. There was no reason why Jimmy couldn't have remained there indefinitely.

When he gets a sweetheart deal, he has to defy the system and have a last minute revelation to tell the full truth. We could argue that this is Jimmy finally submitting and changing, but that's open to interpretation.
